In January 2025, the U.S. Department of Transportation (DOT) initiated legal action against Southwest Airlines, alleging the operation of chronically delayed flights that disrupted passengers’ travel plans. This lawsuit underscores the DOT’s commitment to ensuring airlines provide realistic and reliable flight schedules.
The Allegations
The DOT’s lawsuit focuses on two specific Southwest routes:
- Chicago Midway International Airport to Oakland, California
- Baltimore/Washington International to Cleveland, Ohio
Between April and August 2022, these flights experienced 180 disruptions, each being chronically delayed for five consecutive months. A flight is classified as “chronically delayed” if it operates at least ten times a month and arrives more than 30 minutes late over 50% of the time.
Southwest’s Response
Southwest Airlines has expressed disappointment over the lawsuit, particularly given that the incidents occurred over two years ago. The airline emphasizes its overall performance, noting that since the DOT’s Chronically Delayed Flight (CDF) policy was implemented in 2009, Southwest has operated over 20 million flights without similar violations. In 2024, the airline completed more than 99% of its flights without cancellations.
This legal action is part of a broader initiative by the DOT to enforce realistic scheduling practices across the airline industry. Earlier in January 2025, JetBlue Airways was fined $2 million for operating chronically delayed flights. Additionally, Frontier Airlines faced a $650,000 fine for similar issues.

Implications for Travelers
For travelers, especially those who value punctuality and reliability, this lawsuit highlights the importance of realistic flight schedules. While Southwest has a strong overall performance record, the DOT’s actions serve as a reminder that airlines must adhere to standards that ensure timely and dependable travel experiences.
